Terms of Use

These terms are an agreement between you and Cody Morrison, a sole trader in Brisbane, Queensland, Australia, trading as Rhythm Revolt Records (“we”, “us”). They cover the RevTalk app, this website, and anything else we offer under the RevTalk name (together, “RevTalk”). By creating an account or using RevTalk you agree to them. If you do not agree, do not use RevTalk.

1. Who can use RevTalk

You must be 18 or older, and legally able to enter this agreement. You may have one account. Do not share your account or sign in as someone else. If you use RevTalk for a club or business, you confirm you can accept these terms for it.

2. Your account

You can sign in with an email address, a phone number, or Sign in with Apple or Google. Give us accurate details and keep your sign-in secure. You are responsible for what happens on your account. Tell us at support@revtalk.app if you think someone else has got in. You can delete your account at any time in the app under Settings.

3. Drive safely and follow the law

RevTalk is built to be voice first, and to be set up before you drive. You must:

RevTalk is not an emergency service. In an emergency call 000 (or your local emergency number). You are solely responsible for how you drive. We are not responsible for any fine, demerit point, accident, injury or loss that results from how you use RevTalk while driving, to the fullest extent the law allows.

4. What RevTalk does

RevTalk shows nearby drivers on a map, and connects voice between drivers who are within range, and between members of the same group. It also provides road reports, navigation, saved places and routes, and group route voting. Some limits apply today, for example how many people you can talk to at once, how large a group can be, and how far apart drivers must be to connect. These limits may change as we test and improve RevTalk.

RevTalk depends on your phone, your location signal and your mobile or Wi-Fi connection. We do not promise it will always be available, error free, or uninterrupted, or that voice will always connect or sound good. Maps, street names, routes and travel times come from third parties and can be wrong or out of date. Use your own judgement and obey road signs.

5. Road reports and police alerts

Road reports (such as hazards, crashes, roadworks, stopped vehicles and police) come from other users. They are not checked by us. They may be wrong, late, or missing, and you must not rely on them instead of your own judgement.

The rules about police and enforcement alerts differ by country and region. In some places RevTalk shows police reports only as wide danger zones, and in others it switches them off. We may change, limit or remove any feature in any place at any time to follow local law. You must not use RevTalk to break the law, to avoid lawful enforcement of the law, or to interfere with the work of emergency services or police. RevTalk does not encourage speeding or any dangerous or illegal driving.

Do not report something you have not seen. Repeated false reports may lead to action against your account under section 9.

6. Voice, recording and other people

We do not record your voice conversations. Voice goes directly between phones. You must not record, capture, store or share another person’s voice, or screenshots of their details, without their consent. Laws about recording private conversations are strict, including in Queensland, and you are responsible for following them.

If you use voice commands, your phone’s speech service (Apple’s or Google’s) may process what the microphone hears under its own terms. See our Privacy Policy.

You must not use RevTalk, including your name, car description, plate, scene tags, group names or voice, to:

8. Groups and Lead Cars

A group is run by its Lead Car. The Lead Car can send a destination to the group, and the group can vote on the route. Joining a group lets its members see your name, your car, and your position, and talk to you at any distance. Only join groups you trust. If the Lead Car leaves, the lead passes to another member. We may remove or close any group that breaks these terms.

9. Reports, blocking and action on accounts

You can mute, report and block other users in the app. When someone is reported we may review the report, the names involved and the reason. If you break these terms we may warn you, limit features, suspend your account for a time, or end it for good. We may do this without notice when we think safety is at risk. If you think we got it wrong, email support@revtalk.app with your account details and we will look again. We may share information with police or other authorities where the law requires it, or where we reasonably believe it is needed to prevent a serious threat to a person’s life, health or safety.

10. Our property and your content

RevTalk, its design, logo, software and content belong to us or our licensors. We give you a personal, non-exclusive, non-transferable, revocable licence to use the app on your own devices under these terms.

You keep ownership of what you provide, such as your name, car details and group names. You give us permission to store it, show it to the other users you have chosen to show it to, and use it as needed to run and protect RevTalk. If you send us feedback or ideas, we may use them without paying you.

Map data is © OpenStreetMap contributors, or from the map provider named in the app. RevTalk includes open source software, which is covered by its own licences.

11. Third-party services and app stores

RevTalk uses third-party services, for example for maps, directions, sign-in, email and text messages. Their own terms apply to those services. If you download RevTalk from the Apple App Store or Google Play, the store’s terms also apply. Apple and Google are not responsible for RevTalk or for support for it, and they are not parties to this agreement, although Apple may enforce these terms against you as a third-party beneficiary where Apple’s own terms say so.

12. Price and changes to the service

RevTalk may include paid features in the future. If we add them, we will show the price clearly before you pay, and you can say no. Store billing terms will apply to anything bought through an app store. We may change, add or remove features, or stop RevTalk, at any time. If we stop RevTalk, we will give you reasonable notice where we can.

13. Ending your use

You can stop using RevTalk and delete your account in the app at any time. We may suspend or end your access if you break these terms, if the law requires it, or if we stop the service. When your account is deleted we remove your data as explained in the Privacy Policy. Sections that by their nature should continue after the end of your use will continue.

14. Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded. Our services come with guarantees that cannot be excluded under the Australian Consumer Law, including that services will be provided with due care and skill.

These terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland. Before starting any formal dispute, please contact us at support@revtalk.app so we can try to sort it out.

17. Changes to these terms

We may update these terms. If a change is important, we will tell you in the app or by email before it takes effect. If you keep using RevTalk after a change takes effect, you accept the new terms. The date at the top shows when they were last updated.
